  Trading Terms

This is the Selective Image  (ABN 42 345 660 369) “Trading Terms and Conditions”. The Selective Image Trading Terms and Conditions is subject to change without notice - changes will be posted on this website. By placing an order from Selective Image signifies that you (the “BUYER”) has read and accept the Selective Image Trading Terms & Conditions shown below:

CONTENTS:

1.0  Prices:

  • All prices are quoted in AUD (Australian dollars) and inclusive of 10% GST (Goods & Services Tax), unless specified otherwise. Australian GST does not apply to International Orders and will be deducted from all GST Inclusive prices at the time of order.
  • Special prices/offers/promotions offered on our website are available when placing online orders only.
  • Product prices quoted exclude delivery fee.
  • Pricing and stock availability is for informational purposes only and is not final until order confirmation has been given to the BUYER by email, fax, or phone.
  • Prices subject to change without notice.

2.0  Product Images & Packaging:

  • Product images and packaging shown on our website are for promotional illustration purposes only and may change without notice.

3.0  Freight Cost:

  • Our “STANDARD DELIVERY” fee is just a low $6.00 FLAT RATE, Australia wide (excludes some remote/country areas). If you are located in the remote/country areas, it is advised that you contact Selective Image to confirm whether we can deliver to your specific remote/country area - NOTE: HIGHER FREIGHT CHARGE MAY APPLY. This “standard delivery” fee is for consumers only, not dealers/resellers, and does not apply to International customers.
  • Orders totaling $100 or more is entitled to FREE STANDARD DELIVERY Australia Wide (excludes some remote/country areas). This special offer is for consumers only, not dealers/resellers, and does not apply to International customers.
  • Freight costs and terms subject to change without notice.

4.0  Delivery & Turnaround:

  • Most orders made within Australia will take about 3 working days after payment is credited to our bank account. If urgency/express service is required then please contact us and we will arrange an EXPRESS delivery service for you at an additional cost to you.
  • SELLER shall not be held responsible for delays in delivery of BUYER’s orders.
  • We DO NOT deliver to Post Office boxes, unless it has been pre-authorized/pre-arranged with SELLER, and only under certain "SPECIAL" conditions.
  • We DO NOT allow order pick-ups from our premises - SELLER is NOT a "Walk-In" shop.
  • BUYER shall bear the freight cost for re-delivery of order due to incorrect delivery details given by the BUYER and BUYER shall also be charged an additional $20 "administration fee" for redirecting BUYER's order to a different address.
  • Delivery turnaround is also dependent on the time it takes to clear & confirm payment.
  • SELLER shall have the right to charge a $20 "administration fee" in addition to any additional courier fees for redirecting orders to a different address. Delivery redirection must be requested in writing and signed and dated.

5.0  International Orders:

  • International service is currently not available.

6.0  Stock Availability:

  • We will try to maintain a good supply of stock for items published on our website, however, SELLER shall not be held responsible for running out of stock - this rarely occurs, but may occur due to unexpected large orders or other factors.
  • Orders shall be processed and delivered subject to stock availability. We may also run out of stock on some items which are listed on our website as “In Stock” due to unprocessed orders or other reasons. However, in the event that we do run out of stock, we will place your order on “back-order” and inform you about it to request whether you would like to cancel the order or place it on “back-order”.
  • All “back-orders” for Australian destinations will be delivered FREE OF CHARGE.

7.0  Order Cancellations:

  • Selective Image reserves the right to cancel orders if payment is not received within 7 days of Selective Image having given an "Order Confirmation" to BUYER. Selective Image will only reserve goods ordered by BUYER for no longer than 7 days, thereafter the goods are no longer "reserved" and may be offered to another BUYER (a third party) and the 1st BUYER's order MAY be cancelled.

8.0  Payment Options & Terms:

  • All payments must be made in advance prior to delivery of order.
  • BUYER may pay by credit card (VISA, MASTER CARD, or BANKCARD) if using the third-party “PAYMATE” secure payment service provider - please note that PAYMATE may charge you a fee for their services. For more info about the PAYMATE payment service, please see our “How To Order” section.
  • BUYER may choose to pay by personal/business/bank cheque, money order, or direct bank deposit/transfer to SELLER’s bank account - please see below for our Bank details. If you wish to pay with credit cards then you MUST use PAYMATE, a third-party secure payment service provider.

  • Cheques and Money Orders are to be made payable to “Selective Image”.
  • Cheques must be cleared prior to delivery of order and may take approximately 3 working days to clear.
  • If paying by Direct Bank Deposit/Transfer, please fax us a copy of the Bank’s Transfer Receipt, or phone or email the Transaction details to us for confirmation of transfer.
  • SELLER reserves the right to charge BUYER a fee for re-presenting BUYER’s cheques if BUYER’s cheques “bounce”.

9.0  Warranty:

  • All goods purchased from SELLER is covered by a 12 month return-to-base manufacturer’s warranty, unless specified otherwise, from the date shown on SELLER invoice. Continuous Ink Supply Systems (CISS) are covered by a 3 month warranty.
  • Goods returned for warranty shall attract a minimum $55 labour fee in addition to freight, for the return of goods to BUYER, in the event that the goods are found to be NON-DEFECTIVE!
  • To the extent permitted by law, warranty excludes other equipment damaged while used in conjunction with goods purchased from SELLER, only goods purchased from SELLER is covered by warranty.
  • All goods sold with Anti-Static bags must be returned in Anti-Static bags or warranty is void.
  • All products returned for warranty must have a specific detailed fault description, just describing goods in the lines of “faulty”, or “not working”, or other similar “general” expressions, is not acceptable and may result in further delays in honouring warranty.
  • Warranty will not be honoured for goods returned to SELLER with signs of physical damages or mishandling.
  • Warranty does not cover goods damaged by power surges, power fluctuations, power interference, bad electrical wiring, third party equipment, computer viruses, misuse, and inadequate packing by BUYER when returning goods to SELLER.
  • The removal of serial numbers, manufacturer seals, or warranty labels will also void warranty. Warranty is void if goods are tampered with in any way!
  • BUYER shall bear all associated freight costs, to and from SELLER, for goods returned to SELLER for warranty claims.
  • "Dead On Arrival" (DOA) Goods: If BUYER receives goods which are "Dead On Arrival", it MUST be reported to SELLER within 24 hours of receipt, or next business day, for the goods to be classified as "Dead On Arrival". Upon receipt of notification from BUYER, SELLER shall arrange for the DOA goods to be returned to SELLER. DOA goods shall be replaced or a full refund given to BUYER. It is BUYER's responsibility to inspect goods immediately upon receipt of delivery. If it is determined by SELLER that the goods are not DOA, that the goods are actually damaged due to misuse, mishandling or wilful damage, then SELLER shall invoice BUYER a processing fee plus all freight costs associated with the return of goods. DOA goods do not include damaged goods resulting from mishandling by freight/courier service providers, such damages are the responsibility of the freight/courier service provider - please see "Damaged In Transit" (DIT) Goods. Original product packaging for DOA goods must be supplied to SELLER for inspection upon request.
  • "Damaged In Transit" (DIT) Goods: If you receive goods that appear to be "Damaged In Transit" that is, during delivery from Selective Image to you, then you should NOT accept the delivery and instruct the courier to return it to SELLER and report the incident to SELLER immediately, within 24 hours or next business day. Some of the signs to look out for include physical damage to the packaging or goods, such as indentations to the exterior postal packaging, opened packaging, or packaging that appears to have been tampered with. If any of these signs are visible then it is BUYER's responsibility to refuse acceptance of delivery.
  • Packing Errors & Shortages: All packing is done under "STRICT MONITORING" and contents are carefully checked prior to despatch. However, in the event that BUYER claims there is a packing error or shortage, BUYER MUST notify SELLER within 24 hours, or next business day, of receipt of the goods. Goods that come in transparent packaging, where goods are visible, MUST NOT be opened, opening such packaged goods voids your claim.
  • Goods returned for warranty shall be repaired, replaced with identical or similar item, or credit given based on "Current Market Value", at SELLER’s discretion. No cash refunds will be given for goods returned for warranty purposes.
  • Goods returned for warranty which have been repaired must be claimed by BUYER within 30 days of notice from SELLER, that the repaired goods are ready to be claimed. SELLER shall not be responsible for the repaired goods if BUYER does not claim the repaired goods after 30 days of notice from SELLER, and thereafter SELLER shall have the right to dispose of the repaired goods, and BUYER waives ownership to said goods. BUYER shall be responsible for the freight costs involved in returning the repaired goods to BUYER, and BUYER agrees to pay freight costs in advance to SELLER prior to delivery of the repaired goods to BUYER.
  • Goods which are identified by SELLER as a “CLEARANCE” item or a “DISCONTINUED” item at the time of purchase by BUYER are only covered by a 30 day warranty.
  • Goods returned under warranty are only processed by SELLER on behalf of the BUYER, the warranty is provided by the manufacturer, unless specified otherwise.
  • All warranty claims must be accompanied by SELLER’s “Return Authorization Form” (RA Form) and a “Return Authorization Number” (RA Number) - see below for more info about “RA Form” and “RA Number”.
  • Credits given for goods under warranty must be used within 90 days from the date issued or the credits shall be forfeited.

10.0  Refunds & Return Policy:

  • All goods returned to SELLER must be accompanied by SELLER’s “Return Authorization Form” (RA Form) and a “Return Authorization Number” (RA Number). Prior to returning goods, please contact SELLER for an RA Form and an RA Number. Without the SELLER RA Form and RA Number, goods returned to SELLER will NOT be accepted and BUYER shall bear all associated freight costs for returning the goods to BUYER. BUYER is responsible for keeping a “copy” of the completed RA Form for their own records. Once SELLER has assigned an RA Number to the goods brought to SELLER’s attention, that particular RA Number may only be applied to the goods approved to be returned at that time and once the return has been approved and an RA Number has been assigned, BUYER must return the goods to SELLER within 7 days of approval or a new RA Number must be obtained.
  • All goods returned MUST be accompanied by a SELLER’s invoice or purchase receipt. Goods returned without proof of purchase (receipt) will NOT be accepted!
  • All goods returned MUST be returned to the "PLACE OF PURCHASE".
  • REFUNDS: Refunds shall be given if the goods are considered as not "merchantable quality", "Dead On Arrival", or as required by statutory law. If the goods are considered "Dead on Arrival" then the BUYER is required to follow the "Dead On Arrival" terms/procedure as specified in the "Dead On Arrival" clause, in order to qualify for a refund. Refunds shall not be given if you have changed your mind, bought the wrong item or bought the wrong colour or size, or have found a cheaper price. No refunds, exchanges or credit shall be given if the goods have been opened, used, and are non-defective, except where the product comes with a "Satisfaction Guaranteed" policy - note, "Satisfaction Guaranteed" policy only applies to consumers, not resellers, unless stated otherwise. BUYER shall be responsible for arranging and paying for insurance and all freight costs associated with the return of goods that come with the "Satisfaction Guaranteed" policy and these freights shall not be reimbursed by SELLER. All goods that are returned under the "Satisfaction Guaranteed" policy MUST be returned in its original packaging and returned within 7 days of purchase. No refunds, credit or exchange shall be given for goods returned which show signs of tampering, modification, misuse or damaged accidentally or wilfully. Due to copyright reasons, software may not be returned for a refund. Any defective software shall be replaced, if returned within 7 days of purchase. SELLER shall have the right to offer a partial refund for goods returned that have been used. In any case, refunds shall only be given if goods are returned to the SELLER within 7 days of purchase.
  • SELLER is not responsible or liable for the time or expense incurred by BUYER in relation to returning goods to SELLER and SELLER does not offer equipment/product loans to BUYER while goods are undergoing returns/warranty processing. However, SELLER shall reimburse BUYER for freight cost associated with returning "Dead On Arrival" goods. SELLER is not responsible for BUYER relying on SELLER's goods to perform without fault/defect to meet their schedule.
  • All goods covered by money back “Satisfaction Guaranteed” policy, must be returned within 7 days of purchase, if the BUYER is not satisfied with the goods.
  • Please read our WARRANTY section if returning goods for warranty purposes.

11.0  Title To Goods:

  • All goods remain the property of SELLER until fully paid for by BUYER.
  • Title and ownership of the goods shall pass to the BUYER after the BUYER has fully paid for the goods, and until then, BUYER is simply holding the goods for and on behalf of the SELLER, fully insured by BUYER against loss and physical damage.

12.0 Disclaimer:

  • To the maximum extent permitted by law, SELLER shall not be liable for printing errors, omissions, errors in photography or typography, expressed claims made by manufacturers regarding their products, SELLER shall not be liable for any incidental or consequential damages, special or indirect damages, relating to the use, misuse, performance, of any goods purchased from SELLER, including but not limited to, loss of business, loss of profits, loss of contracts, and loss of time.
  • To the maximum extent permitted by law, BUYER acknowledges and agrees that SELLER shall not be responsible for errors or omissions relating to the accuracy, reliability, or completeness of the information presented in this Website, errors and omissions accepted.
  • To the maximum extent permitted by law, Selective Image does not guarantee the security of this website, nor give any warranty of reliability of this Website and the information found on this Website. The information on this Website should only be considered as “general” information, and should not be relied upon as 100% accurate and complete. SELLER does not guarantee that SELLER’s website is free from service interruptions or error-free or "up to date".
  • SELLER’s total liability under any circumstances will not exceed the total cost of the price paid for the goods and/or services. Because some states may not allow the exclusion or limitation of liability for incidental or consequential damages, the above exclusions or limitations may not apply to you.

13.0 Personal Information:

  • In order to provide some of SELLER’s services to BUYER, BUYER agrees to provide accurate and up to date personal information, as requested by SELLER for that particular service. If BUYER refuses to supply the requested personal information for that particular service then SELLER shall have the right to not provide that particular service to BUYER.

14.0 Termination:

  • Selective Image may, at our sole discretion and at any time, terminate our services to you, in part or in whole, without notice to you and without cause.

15.0 Reservation of Rights:

  • Selective Image reserves the right to add, remove, or modify any part of our Trading Terms and Conditions, as required by Selective Image, without notice to you, and you agree to be bound by such amendments if you continue to use our services and/or purchase goods from us. Please ensure you check the Selective Image Trading Terms and Conditions regularly, any changes to The Selective Image Trading Terms and Conditions shall be posted on the Selective Image website.

16.0 Additional Terms & Conditions:

  • In addition to these Trading Terms and Conditions, your use of the Selective Image Website is subject to further terms and conditions. By using the Selective Image Website, you are also bound by the Selective Image Website Terms and Conditions of Use. Furthermore, if you give us personal information, then you acknowledge that you have read and accept the Selective Image Privacy Policy.

17.0 Acceptance of SELLER’s Trading Terms and Conditions:

  • By using our services or purchasing goods from Selective Image signifies that you (the “BUYER”) has read and accept the Selective Image Trading Terms & Conditions.

18.0 Governing Law:

  • SELLER’s Trading Terms and Conditions shall be governed by the laws of the state of Victoria, Australia. If any terms, conditions, provisions are deemed to be invalid or unlawful by any court with jurisdiction, that term, condition, provision shall be considered to be removed and any other existing terms, conditions, provisions shall remain valid.
